'The Shape of Things to Come' - Right To Manage

The Law Commission Consultation Paper, and What it Means for Property Managers

On Monday 28th January 2019 the Law Commission published its eagerly awaited consultation paper on reform of the Right To Manage (RTM).

The proposals are designed to make the RTM cheaper, simpler and available to a greater number of Leaseholders, while removing the many technical traps which have plagued RTM claims since the Commonhold and Leasehold Reform Act 2002 came into force.

Some of the more radical suggestions include scrapping the 25% cap on non-residential premises and enabling one RTM company to acquire the right to manage more than one block, and even leasehold houses.

The Law Commission have also prepared a short survey for Leaseholders and RTM Company Directors, to collect data about experiences of the RTM.

The consultation period is open until 30th April 2019.
