Validity of a Will

There are circumstances when the validity of a Will can be challenged and should be disregarded.

  • Invalid Procedure - In order for a Will to be valid, it must be in writing and signed and witnessed in the correct manner
  • Mental Capacity - A person making a Will must have sufficient mental capacity at the time the Will was signed. They must have the knowledge to understand the contents and the effects of the contents
  • Undue Influence - Making a Will is the voluntary right of an individual. If someone has undue pressure put on them, or has been coerced into making a Will against their wishes, it may be deemed as invalid
  • Fraud or forgery - Where there is fraudulent activity surrounding the preparation of a Will then the Will may be deemed invalid.
