Shariah Compliant Wills

In order to fulfill religious obligations, it is important for all Muslims to execute a Shariah Compliant Will, some times known as an Islamic Will; a basic Will that may have been prepared is not sufficient.

It is important to ensure that not only does a Shariah Compliant Will adhere to the principles of Islam and the Quran, but it is also tax efficient and compliant with the laws of England and Wales. Planning ahead is essential in order to preserve assets and mitigate tax where possible.

If you do not write a Will and you pass away, your assets will pass according to the UK rules of intestacy and these laws are vastly different to the criteria of the Quran and Shariah Law.

An Islamic Will allows you to:

  • Appoint Executors (a friend, relative or lawyer) to handle your estate after you have died
  • Appoint guardians of any minor children
  • Make provisions for any minor children so you can invest inheritance for their maintenance, education or benefit. This can be invested in Shariah compliant trusts
  • Distribute your Estate in the correct proportions which are laid down in the Quran
  • Specify who you would like your ‘up to one third bequests’ to go to
  • Specify any charities you may wish to benefit
  • Specify any funeral wishes.
