RMC and Company Law Issues

An RMC will have to be incorporated and run in the same way as other companies and we have the right package (B-Sec) and expertise to satisfy your compliance needs.

An RMC is very different from an informal residents’ association; it carries legal status and offers greater protection to all involved.  Setting up an RMC can be a fairly complex task and specialise legal advise should always be obtained as although property law regulates matters relating to the residential long lease, company law regulates the setting up and operation of flat management companies. 

Once an RMC is set up it will also have to comply with the formalities required by Companies House for example, it will need to, amongst other things to ensure that RMC Memorandum and Articles of Association are used, file an Annual Return, keep up-to-date the RMC’s Statutory Books and Registers, keep Companies House updated on membership of the RMC, deal with Change of Name formalities and the filing of certain Resolutions.
