Financial Issues on Divorce (Ancillary Relief)

Financial Issues Divorce Factsheet

The costs that can be associated with dealing with financial provision following a divorce can sometimes spiral out of control.  It was Zsa Zsa Gabor who said “I'm an excellent housekeeper. Every time I get a divorce, I keep the house.” The media on many occasions feature horror stories where couples spend tens of thousands of pounds arguing over who gets what and how much maintenance should be paid by one spouse to another. It does not have to be this way.

Brethertons is the first solicitor firm to offer a fixed price ancillary relief package which enables parties to know in advance what the legal costs are likely to be for dealing with matrimonial finances following divorce.

In order to set a fixed price, the process of resolving the financial arrangements on divorce has been broken down into four steps.  This unique Step fixed price process has been developed by Linda Jones, the Head of our Matrimonial Team.

The four steps are:-

Step 1 Disclosure
Financial Disclosure and Negotiation
Step 2 Directions
From Issue of Application to first Directions Appointment
Step 3 FDR
Financial Dispute Resolution Hearing
Step 4 Final
Hearing - From FDR to attending a final hearing

At each step we will try to negotiate a financial settlement for you in an attempt to avoid the next step.

You may have dealt with one step on your own and require help with other steps, this is perfectly acceptable and the system we have designed allows clients to seek help at what ever stage they are in the process.

Who can use the Fixed Price Service?

The fixed price service is suitable for the majority of people getting divorced who have a genuine desire to reach a sensible financial arrangement with their spouse and want to use the expertise and service of a Solicitor whilst remaining in control of the costs.  We will take all necessary information and instructions from you using electronic methods, or if you prefer, at an initial meeting.

This fixed price service is only available to clients with combined gross assets of below £300,000 and who do not have any assets outside England and Wales.  If you have assets above this level it is likely that one of our solicitors will need to spend a greater amount of time dealing with your financial affairs so please either telephone us on (01788) 532926 or arrange a free consultation using our on-line ‘book a consultation form’.
