Collaborative Law

Collaborative law is a new approach to dealing with issues involved when a relationship breaks down.  Collaborative law involves the parties and their specially trained solicitors working together to resolve issues and avoid Court, but reach an agreement which can be contained within a legally binding document. 

If no settlement can be reached new lawyers will need to be instructed for court proceedings.  This is to avoid lawyers threatening court action.

1.  What is the process?

  • You and your partner agree to resolve issues without going to Court and instructing specially trained collaborative lawyers.
  • Negotiations and discussions take place face to face with parties and their lawyers present.
  • Obtaining full disclosure without threat of court action.
  • The parties remain in control and make decisions about their future and children with lawyers there for advice and guidance.
  • When an agreement is reached it can be contained within a legally binding agreement.

2.  Is it for me?

Yes if:

  • You want to be in control of decisions and want a dignified non-aggressive resolution of issues.
  • You want to protect your children from protracted Court proceedings.
  • You want to resolve matters in a cost effective way.
  • Your main aim is not to seek ‘revenge’ on your partner.

3.  What are the costs involved?

Time spent on your matter is charged by the hour and the cost really depends on the number meetings and issues involved.  Collaborative law is often more cost effective than court action.
