If you are unhappy with a will and wish to challenge it’s contents, or have not benefited when you think you should have because someone has died without a Will, then we can help you contest it.  We act for executors, beneficiaries and claimants as well as for minors and guardians of minors.  
  • Not all firms of solicitors provide Contentious Probate services and at Brethertons we have a dedicated team who have the expertise to help you.

Problems may arise on the death of an individual, either as a result of Intestacy or Will where the deceased has made no, or insufficient, provision for a dependant or wife/husband. In these instances, parties will require advice as to what their legal position is and whether they have a potential claim or not, and indeed we will consider all their options. 

This is often a very sensitive time for parties and we will deal with any instructions sympathetically, but with a view to resolving the issues as soon as possible within the strategy that we adopt.

Arguments can also arise if it is alleged that the deceased made their Will under duress or when their mental capacity was impaired and we can deal with problems that can arise in this way.

Various means of funding are available which can be discussed.
