Meet the Team

Felicity Wyatt, Solicitor, Head of the Agricultural & Rural Business Department - Banbury.
 
Felicity specialises in Agricultural and Rural Business law.  She is Head of the Agricultural & Rural Business Department of Brethertons in Banbury.  She acts for clients in all matters affecting the agricultural sector, including in sales, purchases, remortgages and inter-family transfers of land, as well as on issues affecting public rights of way and on some boundary issues.  She is an experienced Agricultural Solicitor with a Masters in Agriculture Law, who advises in relation to agricultural quotas and subsidies, has a detailed knowledge of the Single Payment Scheme entitlements system, and advises clients considering entering the Entry Level and Higher Level Environmental Stewardship schemes, as well as those transferring land within these schemes, or acting for those acquiring land within these schemes.
 
Felicity has a detailed knowledge of the two statutes which govern agricultural lettings, namely the Agricultural Holdings Act 1986 and the Agricultural Tenancies Act 1995, which created the farm business tenancy.  She advises clients in relation to the terms of grazing and/or mowing licences, of commercial leases of farm buildings, and of residential lettings on agricultural property.  She undertakes complicated first registrations of large estates, and advises on the granting of easements, to individuals for rights of way, or the right to take clean water or to drain dirty water or sewage across another landowner’s property.  She also advises landowners in the granting of wayleaves across their land to statutory undertakers for service conduits, or in matters relating to telecommunications providers, for example in issues relating to leases for mobile telephone masts.

Kate Austin, Legal Executive (FILEX) Head of the Agricultural & Rural Business Department - Rugby

Kate, who joined Brethertons in 2002, is a Fellow of the Institute of Legal Executives and is a key component in Brethertons’ provision of Agricultural and Rural business advice. Kate has 20 years of property law experience and advises on agricultural and residential property transactions including sales, purchases, remortgages and deeds of easements.
 
Kate also has experience in dealing with a wide variety of applications to the Land Registry including adverse possession claims, complex voluntary registration applications, rectification of title registers and plans and definition of boundaries.
 
Kate's clients include farmers acquiring land to expand their family farm, clients adding to their agricultural holding portfolio and clients acquiring properties with ancillary equestrian facilities. David Hodge, Agricultural Employment Law Specialist

David is Head of the Brethertons’ Employment Law team and a specialist employment solicitor with a difference - he has a rare niche specialism in rural employment law matters, assisting farmers in negotiating some very technical legislation.

The agricultural sector currently operates under very different rules to the rest of industry and basic employment rights and obligations are dictated each October by the Agricultural Wages Board (AWB). Although the future of the AWB is uncertain, these sometimes complex rules (which are not widely understood, even by specialist employment lawyers) remain with us and those who employ Agricultural Workers must ensure their compliance, or face large fines.

As well as helping farms keep on the right side of pure employment legislation, David also advises on associated matters such as the appropriate structure of tied accommodation to ensure that Assured Agricultural Occupancies do not arise. Click here to read more about David Hodge.
