Insolvency

Our Insolvency Group is headed by Edward Bible who is both a solicitor and licensed insolvency practitioner. The Insolvency Group brings together lawyers with different skill sets including corporate law, litigation, property and employment law.  Brethertons is one of the few solicitor firms in the UK to employ a dual qualified solicitor and insolvency practitioner.

The Insolvency Group was awarded the Insolvency Litigation Firm of the Year at the Insolvency and Rescue Awards 2009/2010.

When faced with an insolvency situation, it is vital to seek advice sooner rather than later.  Where appropriate we aim to assist clients who are usually faced with very difficult problems which can affect both their business and domestic assets.  We aim to make the best of the situation, be that assisting clients to keep their businesses going or realise an asset’s best value and minimise exposure, if a business has no option but to cease trading.  We can assist and advise clients who are facing administrations, liquidations, receiverships, bankruptcy, individual voluntary arrangements (IVA’s).

Book Debt Realisation

Brethertons has an award-winning, nationally recognised Commercial Collections Team who are able to collect book debts, quickly, efficiently and economically.  When time is of the essence, proceedings and letters before action can be issued within hours of us being instructed.

Directors Disqualification

We also have considerable experience in representing individuals who may be faced with directors disqualification proceedings.  It is not uncommon following the liquidation of a company for the Insolvency Service to seek undertakings from directors seeking to disqualify them for periods of between 2 and 15 years.  In many cases we are able to negotiate reduced periods of disqualification and can also pursue applications before the courts for leave to allow directors to continue to remain as directors of companies notwithstanding a disqualification order/undertaking  having been made.
